Peter Sagan is set to appear in front of the Court of Arbitration of Sport (CAS) on 5th December, in a case contesting his disqualification from this year's Tour de France.
In a press release on the CAS website, the case is entitled 'Peter Sagan& Denk Pro Cycling GmbH & Co. KG v. Union Cycliste Internationale (UCI)', and is expected to contest Sagan's dismissal from this year's Tour following a crash with Mark Cavendish (Dimension Data).
The high-profile crash into Vittel saw Sagan disqualified from the race after it was judged that the Slovakian had raced dangerously, endangering multiple riders.
The crash saw Cavendish abandon the race due to a broken shoulder blade.
Initially, the five-time Green Jersey winner had 80 points deducted in that competition and was docked 30 seconds on General Classification, ruling out Sagan's chance at taking the race lead.
Yet, after much deliberation and confusion, the UCI race jury found Sagan to be at fault for the crash subsequently disqualifying him from the race.
At the time, both Sagan and Cavendish commented that neither believed the crash to be deliberate however the UCI adjudged elimination to be the appropriate action.
Bora-Hansgrohe announced that an appeal had been lodged with CAS two days after the incident occurred, with particular objections to the lack of conferral the UCI had both with the team and rider.
Next month's case is expected to address the UCI's decision to dismiss Sagan and will look for a reversal of the decision on the rider's palmares.
